Terms of Service
Last updated: Oct 12, 2026
These terms apply to anyone who uses this website or engages Dynasty Media for services. They are made up of three parts: our Terms and Conditions, our Service Delivery Policy, and our Refund and Cancellation Policy.
When you sign a project proposal with us, these terms form part of that agreement. If your signed proposal or project outline says something different from this page, the signed proposal applies to your project.
Part A: Terms and Conditions
1. Definitions
- "Dynasty Media", "we", "us", "our" means Dynasty Media, the service provider.
- "Client", "you", "your" means the person or business that engages us or uses this website.
- "Project outline" means the signed proposal, quotation or outline that lists the services, deliverables, fees and timelines for your project.
- "Deliverables" means the content, designs, websites and other work we produce for you under a project outline.
- "Agreement" means your signed project outline together with these terms.
2. Using this website
The information on this website is a general description of our services. It is not an offer that you can accept online. A binding agreement only exists once both parties sign a project outline.
We work hard to keep this website accurate and available, but we do not guarantee that it will always be error-free or uninterrupted. You may not copy, reuse or republish our website content, branding or portfolio work without our written permission.
3. Our agreement
Only the services listed in your signed project outline form part of the Agreement. Any additional work is welcome and will be quoted separately before it begins.
4. Our commitment, and what we need from you
We commit to delivering the agreed scope of work to a professional standard and within the agreed timelines. If we fall short of that scope, let us know and we will remedy it at no extra cost.
In return, you agree to:
- provide the information, materials, approvals and feedback we need, on time;
- make sure anything you supply to us (logos, images, text, music, data) is yours to use, or that you have permission to use it;
- pay invoices when they are due.
Delays on your side shift our deadlines accordingly.
5. Fees and payment
- Fees are set out in your project outline or quotation. Quotations are valid for 30 days.
- A 50% deposit is payable before work begins. The balance is due on completion, unless agreed otherwise in writing.
- Invoices are payable within 7 days.
- Late payment may attract interest at a lawful rate, and we may pause work until payment is received.
- Third-party costs, such as domains, hosting, ad spend, registration fees and stock assets, are for your account.
6. Content and deliverables
We create content strictly as agreed in your project outline, and you approve it before handover. Once content is delivered and approved, you decide how, where and when it is used. You are responsible for the outcomes of publishing it, including audience reactions, platform decisions, and compliance with any rules that apply to your industry or region.
We do not guarantee specific results such as follower growth, engagement, leads or sales, as these depend on factors outside our control.
7. Third parties
Where we assist with registrations, domain purchases, hosting, website setup or similar services, we act as a facilitator based on the information you provide. Registrars, hosting companies, social media platforms, government bodies and other institutions are independent third parties. We cannot control their decisions, delays, outages or fees, and we are not liable for their actions or omissions.
You are responsible for the accuracy of the information you give us and for your own ongoing obligations, such as renewals, filings and compliance. We do not provide legal, tax or financial advice. Domains are registered in your name wherever possible.
8. Intellectual property
Once your invoices are paid in full, the final approved deliverables are yours. Until then, all work remains ours. We keep ownership of our own tools, templates and know-how.
We may showcase completed, published work in our portfolio and on our social media, unless you ask us in writing not to.
9. Privacy and confidentiality
We handle your personal information lawfully, securely and only as needed to deliver our services, in line with applicable data protection laws, including the Protection of Personal Information Act (POPIA) where it applies. We do not sell your personal information.
Both parties agree to keep each other's confidential information confidential, during and after the Agreement.
10. Liability
We act with reasonable skill and care at all times. However, we are not liable for:
- the actions or omissions of any third parties;
- indirect or consequential losses, such as loss of profits, data or business opportunities.
Our total liability to you, from any cause, is limited to the fees you actually paid for the specific project that gave rise to the claim. Nothing in these terms limits any liability that cannot lawfully be limited, and your statutory rights remain intact.
11. Events beyond our control
Neither party is liable for delays caused by events beyond reasonable control, such as power or network outages (including load-shedding), natural events, or changes in law.
12. Disputes and governing law
If a dispute arises, both parties will first try to resolve it in good faith within 14 days. If that fails, the parties will try mediation, and failing that, the matter may be taken to the courts with jurisdiction where the client's business is located. The Agreement is governed by the laws of the place where the client's business is located.
13. General
- The signed project outline and these terms are the entire agreement between the parties.
- Changes to an Agreement are only valid if they are in writing and signed by both parties.
- If any clause is found invalid, the remaining clauses stay in force.
- We may update this page from time to time. The version in force when you sign your project outline applies to that project.
Part B: Service Delivery Policy
This policy explains how we deliver your project, from sign-off to handover.
1. How a project runs
1.Proposal and quotation. We send you a project outline listing the services, deliverables, fees and timelines. Quotations are valid for 30 days.
2.Sign-off and deposit. Work is scheduled once the project outline is signed and the 50% deposit is received.
3.Onboarding. You send us the information, materials, logins and access we need.
4.Production. We create the deliverables within the agreed scope and timelines.
5.Review and revisions. You review each deliverable and send consolidated feedback.
6.Final approval. You approve the final version of each deliverable.
7.Handover. Once the balance is paid, we hand over the final files, accounts or website, and ownership passes to you.
2. Timelines
Timelines are set out in your project outline and start once we have both the deposit and the materials we need from you. Late materials, feedback or approvals on your side shift our deadlines accordingly. We will tell you as soon as possible if anything on our side affects a deadline.
3. Revisions
Each deliverable includes two revision rounds, unless your project outline states otherwise. A revision round is one set of consolidated feedback on a deliverable. Further revisions, or changes that go beyond the agreed scope, are quoted in advance before we do them.
4. Shoots and sessions
Photo shoots, video shoots, strategy sessions and similar bookings are reserved for you. If you cancel or move one with less than 48 hours' notice, a reasonable rescheduling fee may apply.
5. Approval and handover
You approve all content before handover. Once you approve a deliverable, it is considered final. Edits requested after final approval are treated as new work and quoted separately.
Final files and ownership are released once all invoices for the project are paid in full.
6. Websites, domains and hosting
Where we set up domains, hosting or third-party accounts, we register them in your name wherever possible. Once a website is handed over and approved, its ongoing content, compliance and maintenance are your responsibility, unless we agree otherwise in writing. Renewals of domains, hosting and subscriptions are your responsibility.
7. Delivery standard and remedies
We deliver the agreed scope to a professional standard. If a deliverable does not match what was agreed in your project outline, let us know in writing and we will fix it at no extra cost.
Part C: Refund and Cancellation Policy
Because our work is custom-made for each client and we reserve time for your project, refunds are limited as set out below. Nothing in this policy affects your rights under applicable consumer protection law.
1. Deposits
The 50% deposit secures your place in our schedule and covers work commenced and reserved capacity.
| When you cancel | Deposit |
|---|---|
| Before any work has started | Refunded, less any third-party costs already paid on your behalf |
| After work has started | Non-refundable, except where applicable law provides otherwise |
2. Cancelling a project
Either party may cancel the Agreement on 30 days' written notice. On cancellation:
- you pay for work completed and costs committed up to the cancellation date;
- we hand over all completed work that has been paid for;
- if you have paid more than the value of the work completed and costs committed, we refund the difference.
If either party materially breaches the Agreement and does not fix the breach within 14 days of written notice, the other party may cancel immediately.
3. Rescheduled shoots and sessions
Shoots or sessions cancelled with less than 48 hours' notice may attract a reasonable rescheduling fee. This fee is not refundable.
4. Third-party costs
Amounts paid to third parties on your behalf, such as domains, hosting, ad spend, registration fees and stock assets, are not refundable by us once paid. Any refund of these costs is subject to the third party's own policy.
5. Unsatisfactory work
If a deliverable does not match the agreed scope in your project outline, our first remedy is to fix it at no extra cost. Please tell us in writing what falls short, and we will put it right. Results that depend on outside factors, such as follower growth, engagement, leads or sales, are not grounds for a refund.
6. Approved work
Once you have approved a deliverable, it is considered complete and is not refundable. Changes after approval are quoted as new work.
7. How to request a refund or cancel
Send your cancellation or refund request in writing to the email address below, with your name, project name and the reason for your request. We will respond within 7 business days. Approved refunds are paid by EFT to the account the original payment came from, within 14 days of approval.
